California Notice at Collection

1. Purpose of This Notice

This California Notice at Collection (“Notice”) is provided to California residents pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”). This Notice supplements the Blaise App LLC (“Blaise”) Privacy Policy.

This Notice describes the categories of personal information that Blaise collects about California residents, the purposes for which each category is collected and used, whether the information is sold or shared, and how long the information is retained. This Notice is provided at or before the point of collection as required by California Civil Code §1798.100(b).

2. Categories of Personal Information Collected

The following table describes the categories of personal information Blaise collects, the purposes for collection, whether each category is sold or shared, and the applicable retention period.

3. Sensitive Personal Information

Under the CCPA, certain categories of personal information are classified as “sensitive personal information.” Blaise collects the following categories of sensitive personal information:

  • Social Security Number (partial): Collected via Stripe as part of W-9 tax information for Creators. Blaise does not store full Social Security Numbers. Used solely for IRS tax reporting compliance.
  • Financial account information: Bank account details collected via Stripe for payment processing. Blaise does not store full bank account numbers. Used solely for commission payouts and escrow management.
  • Racial or ethnic origin: Voluntarily provided by Creators and Customers for demographic profile completion. Used for aggregated demographic analytics only. Never shared at the individual level.

Blaise uses sensitive personal information only for the purposes authorized by the CCPA, specifically: to provide the Services you have requested, to comply with legal obligations (tax reporting), and to process payments. Blaise does not use or disclose sensitive personal information for purposes beyond those authorized by the CCPA.

You have the right to limit the use of your sensitive personal information to these authorized purposes. To exercise this right, contact legal@joinblaise.com.

4. Sale and Sharing of Personal Information

Blaise does not sell personal information in exchange for monetary consideration.

Blaise shares certain personal information with Businesses through the Platform's structured analytics features. Under the CCPA, this sharing may constitute “sharing” of personal information as defined by law. The categories of personal information that may be “shared” in this manner include:

  • Identifiers (Creator name and location only)
  • Protected classification characteristics (aggregated demographic data only, Premium/Enterprise tier Businesses only)
  • Commercial information (Creator attribution and redemption data)
  • Geolocation data (aggregated location distributions only, Premium/Enterprise tier Businesses only)
  • Professional information (Creator profile data)
  • Inferences (Creator tier status and performance metrics)

Individual Customer identity, contact information, or unaggregated Customer data is never sold or shared with Businesses.

4.1 Right to Opt Out

You have the right to opt out of the “sale” or “sharing” of your personal information. To opt out:

Blaise honors GPC signals as a valid opt-out request. Please note that for Creators, opting out of data sharing may limit or prevent the attribution of QR code redemptions and the calculation of commissions, as data sharing with Businesses is integral to the Platform's attribution service.

5. Your Rights Under the CCPA

As a California resident, you have the following rights:

  • Right to Know: You may request the categories and specific pieces of personal information we have collected about you, the sources, the business purposes, and the categories of third parties with whom it was shared.
  • Right to Delete: You may request deletion of your personal information, subject to legal exceptions (tax compliance, pending transactions, legal obligations).
  • Right to Correct: You may request correction of inaccurate personal information.
  • Right to Portability: You may request a copy of your personal information in a structured, commonly used, machine-readable format.
  • Right to Opt Out of Sale/Sharing: You may opt out of the sharing of your personal information as described in Section 4 above.
  • Right to Limit Use of Sensitive Information: You may request that we limit the use of sensitive personal information to purposes necessary to provide the Services.
  • Right to Non-Discrimination: Exercising your privacy rights will not result in discrimination, retaliation, or any reduction in the quality or availability of the Services.

5.1 How to Exercise Your Rights

To submit a request, you may:

Blaise will verify your identity before processing any request, which may require confirming your email address or other account information. We will respond to verified requests within 45 days. If additional time is needed, we will notify you. You may designate an authorized agent to submit a request on your behalf, provided the agent provides proof of authorization.

Arbitration provisions in our Terms of Service do not prevent you from exercising your statutory privacy rights under the CCPA.

6. Financial Incentives

Blaise offers a Referral Program in which registered Users may earn a referral reward for inviting new Creators or Businesses to join the Platform. The current reward amount is published on the Platform. Participation in the Referral Program is voluntary and you may withdraw at any time by ceasing to share your referral link.

The Referral Program may constitute a “financial incentive” under the CCPA because it involves the collection of personal information (referral relationships and contact information of referred individuals) in exchange for a monetary benefit. Blaise has determined that the value of the personal information collected through the Referral Program is reasonably related to the value of the referral reward, based on the cost of acquiring new users through other channels.

You may opt out of the Referral Program at any time without affecting your access to the Platform. Opting out will not result in any penalty or change to the Services available to you.
